Nepal native convicted for trying to molest woman


New Delhi: A Delhi court has convicted a native of Nepal, who was employed as a servant at a house in central Delhi, for trying to molest the daughter of his former employer, while setting aside the trial court order acquitting him.

Additional Sessions Judge Savita Rao convicted Devender Gere Nepali, while setting aside the magistrate’s order of acquittal as “not sustainable”.

The ASJ also pulled up the police, saying, “It may be noted that this is a case which speaks volumes about the faulty and poor investigation by the concerned investigating officer (IO).”

The court made the remark as it noted that despite the girl informing the police about Devender injuring her hand, the IO did not get her medically examined, leading to the magistrate finding lapses in the victim’s testimony.

“…If the victim was found having sustained injuries, IO was duty bound to get her medically examined which he failed to do and because of these lapses of the IO, testimony of the complainant (girl) cannot be discarded,” it said.

The girl had said in her complaint that on the intervening night of November 8-9, 2010, Devender, who had once worked as their servant, entered her room, caught hold of her face and tried to pour whiskey in her mouth forcibly and attempted to molest her during which she sustained injuries on her hand.

She had said the accused was apprehended by her family when she raised an alarm.
