KATHMANDU: Nepal Bar Association, the umbrella organization of legal professionals, has sent a letter to the UN appealed to the United Nations (UN) Secretary General Ban-Ki-moon, expressing its deep concern about government Chairman Khil Raj Regmi’s visit to New York to participate in the 68th UN General Assembly and urged Ban to demand Regmi’s resignation from the post of chief justice.
“Regmi accepted the post of Chairperson of so-called Interim Election Council of Minister unconstitutionally, even without waiting the final verdict of the sub-judice case at the Supreme Court against his appointment. In addition, he refused to resign and hold the posts of head of executive and judiciary jeopardizing the notion of independent judiciary,” the NBA stated in the letter addressed to United Nations Secretary General Ban Ki Moon.
The letter signed by NBA Secretary General Sunil Kumar Pokharel has requested Moon to raise the concerns about the protection of independence of judiciary, rule of law and human rights in Nepal. The lawyer’s body is not happy with the appointment of Regmi for the top post of Executive at a time while he is also holding the top post of the judiciary. NBA also organized protest programs against the appointment. However, Regmi has vowed that he will not breach the independence of Judiciary and will not sit at the post of Judiciary while he is assuming the top post of Executive.
“There has been a visible example of his informal influence in the judiciary,” the letter states. “We, therefore, would like to request you raise our concerns with him and further request you to demand his resignation from the post of CJ so as to ensure the independence of judiciary in Nepal,” the letter adds.
IEC Chair Regmi is scheduled to meet UN General Secretary Moon while attending the 68th Session of the General Assembly. The international community has welcomed the formation of Chief Justice led government in Nepal at a time Nepal’s political parties failed to pick consensus Prime Minister from any of the political parties. The major parties finally agreed to form CJ led government to hold the election of the constituent assembly to complete the remaining tasks of constitution drafting after the first constituent assembly failed to promulgate the new constitution. International Community has been appreciating the role of Chief Justice for holding timely election to bring the derailed democratic process back in track.
