Mahato claims govt. has no right to stay in power; Supreme Court authenticates Giri-led NSP

KATHMANDU: Nepal Sadbhawana Party Chairman Rajendra Mahato, who held fast-onto-death for sometime demanding early announcement of the date for election of the Constituent Assembly, has claimed that the significance of Khil Raj Regmi-led election government would end if the government failed to hold the Constituent Assembly (CA) elections in November.

Addressing a press conference at Chandranigapur of Rautahat district on Wednesday, Mahato went on to say that the government which could not announce the date of CA elections so far did not have any rights to stay in the power.

The former minister criticized CPN-UML and Nepali Congress (NC) for their stance on the threshold for the Proportional Representation System, which pushed back the task of promulgating the electoral legislation and held them responsible for the current crisis in the country.

He further said that his party had taken the agenda of maintaining threshold in the proportional electoral system positively. He said that if the major four parties could not forge consensus on the election ordinances then the government should take an initiative for the same. One of the constituent of United Democratic Madhesi Front, the party has been demanding to announce the elections of the constituent assembly at the earliest and also demanding to form the constituency delineation commission.

Meanwhile the Supreme Court has ruled that the Sarita Giri-led Nepal Sadbhavana Party is the authentic party with that name.

Madhesi leaders Khushi Lal Mandal and Shyam Sundar Gupta had also claimed to be the authentic NSP (Anandi Devi). With this verdict, the triangular battle in the court has ended after five years.

Acting upon a petition filed by Giri and Mandal, a division bench of Justices Girish Chandra Lal and Ram Kumar Prasad Sah held that the Giri-led NSP (Anandi Devi) was the authentic party as its General Convention was held under party Chief Anandi Devi Singh from October 17 to 20 in 2008. Anandi Devi, the widow of late Gajendra Narayan Singh had passed away in March 2011.

The duo moved to the Court after the Election Commission had recognized the Gupta-led NSP (Anandi Devi). “We tried repeatedly to get recognition as the authentic NSP (Anandi Devi), but each time the EC rejected us, so, we moved to the Supreme Court and finally truth and justice have prevailed,” Giri said after the verdict.
